It replaces current statutory schemes for enduring powers of attorney and Court of Protection receivers with reformed and updated schemes. The Act covers all decisions on personal welfare including financial matters and also provides substitute decision-making by attorneys, court-appointed "deputies", and clarifies the position where no such formal process has been adopted. The Mental Capacity Act has its basis in the Law Commission Report No 231 on Mental Incapacity that was published in February 1995 after extensive consultation.
